Valid government-issued photo ID is required at pickup and delivery — no exceptions. We reserve the right to refuse any sale or delivery where age cannot be verified or where the recipient appears intoxicated, as required by New York law.
2. Licensed Retailer
Triphammer Wines and Spirits is a retailer licensed by the New York State Liquor Authority. All sales of alcoholic beverages are made in New York State, and title to products passes to the buyer at our licensed premises in Ithaca, NY.
3. Orders and Acceptance
All orders are subject to acceptance and product availability. We may cancel or limit any order at our discretion, including orders that appear fraudulent, exceed quantity limits, cannot be age-verified, or contain pricing or inventory errors. If we cancel your order, you will receive a full refund of amounts charged.
4. Pricing and Product Information
We work hard to keep prices, vintages, product descriptions, and images accurate, but errors occur. Prices are subject to change without notice. Vintages and label designs may differ from images shown. If an item's correct price is higher than the listed price, we will contact you before proceeding or cancel the item and refund you. Sales tax and any applicable bottle deposits are added at checkout as required by New York law.
5. Pickup, Delivery, and Shipping
Orders may be fulfilled by in-store pickup, local delivery, or shipping as described in our Shipping Policy and Local Delivery Policy, which are incorporated into these Terms. Orders not picked up within [14] days may be cancelled and refunded, less any applicable restocking fee.
6. Returns and Refunds
Unopened products in resalable condition may be returned with a receipt within [30] days, subject to applicable law and New York State Liquor Authority rules. Defective products (e.g., corked or spoiled wine) may be returned or exchanged with a receipt. We cannot accept returns of opened products except where the product is defective. Refunds are issued to the original payment method.
7. Responsible Sale
We support responsible consumption. We will not sell or deliver alcohol to anyone under 21 or to anyone who is visibly intoxicated. Purchasing alcohol on behalf of a minor is a crime under New York law.
8. Intellectual Property
All content on this site — text, images, logos, and design — is owned by or licensed to Triphammer Wines and Spirits and may not be reproduced without our written permission.
9. Disclaimer of Warranties
This website and its contents are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.
10. Limitation of Liability
To the fullest extent permitted by law, Triphammer Wines and Spirits will not be liable for indirect, incidental, special, or consequential damages arising from your use of this site or purchase of products. Our total liability for any claim will not exceed the amount you paid for the products at issue. Nothing in these Terms limits liability that cannot be limited under applicable law.
